These terms govern your use of Neda eCampus — the website at nedaecampus.com, the learning platforms at learn.nedaecampus.com and openedx.nedaecampus.com, the account service at auth.nedaecampus.com, and the creator workspace. They are a contract between you and Neda eLearning Solutions, Austria (“Neda”, “we”). Our full identification is in the Imprint.
If you publish courses, the Creator Agreement applies in addition to these terms. If anything in the two conflicts, the Creator Agreement wins for creator matters.
1. Who may use Neda eCampus
Neda eCampus is a professional learning platform for adults. You must be at least 18 years old to create an account. We ask you to confirm this when you register, and we do not knowingly provide services to anyone younger. If we become aware that an account belongs to someone under 18, we will close it and delete the personal data we hold for it. We do not collect dates of birth or identity documents to check age, because doing so would mean collecting more personal data than the service needs.
You may use Neda eCampus as a consumer or on behalf of an organisation. If you accept these terms for an organisation, you confirm you are authorised to do so.
2. Your account
One account signs you in everywhere on Neda eCampus. You may sign in with an email address and password, or through Google or LinkedIn if you choose to. You are responsible for keeping your credentials private and for what happens under your account until you tell us it has been compromised. Tell us straight away at info@neda-els.com if you believe someone else has used it.
You may close your account at any time by contacting us. What happens to your data when you do is described in the Privacy Policy, including the records we are required to keep for tax purposes.
3. What we sell, and who the seller is
Courses on Neda eCampus are created either by us or by independent course creators. In every case Neda is the seller: when you buy a course, your contract is with Neda, Neda issues the receipt, and Neda is responsible to you for delivery of access. Creators license their content to us and are named on the course page so you know who made what you are learning from.
Courses are delivered digitally, on our learning platforms, and are not sent to you as files unless a creator has chosen to make materials downloadable.
4. Prices and payment
The price shown on a course page is the total you pay, including any VAT that applies to you. Where VAT depends on your country, the price shown is calculated for the country we determine you are in; the Privacy Policy explains what we record to make that determination and why the law requires us to.
Prices shown in a currency other than the euro are converted at the European Central Bank reference rate for the day. That rate is indicative: your card issuer or bank applies its own rate and may add fees, and the amount that appears on your statement can differ from the figure we show.
Payment is taken when you place an order. We use a licensed payment provider; we do not see or store your full card details. A course becomes available to you once payment has been confirmed, normally within minutes.
5. Right of withdrawal
If you are a consumer, you have a statutory right to withdraw from a purchase within 14 days. Because a course is digital content that we make available immediately, you lose that right once we have started to provide it with your express consent — which we ask for, and you acknowledge, at checkout. The full rules, the model withdrawal form, and what we do when a course is not as described are in the Refund and Cancellation Policy.
6. How long you can access a course
Access to a course you purchase continues for as long as that course remains available on Neda eCampus. If a course is archived — for example because its creator stops publishing with us — your access continues through the archive retention period that follows. Those archival and retention conditions, including that period, are currently being finalised and will be published before Neda Creator plans become available for purchase. We may remove a course sooner where we are legally required to, or where our licence to the content ends. Your account must be in good standing.
We will give you at least 30 days’ notice by email before a course you are enrolled in is permanently deleted. Where the creator has allowed it, you can download the course materials during that time. We do not use the phrase “lifetime access” anywhere, because it would not be true. The Archival and Retention Policy has the detail.
7. Free courses and enrolment codes
Some courses are free to everyone. Others are open only to people who hold an enrolment code issued by the course’s organisation — typically a university, non-profit or NGO. No payment is involved in either case and no right of withdrawal arises, but these terms still apply to your use. Who may use enrolment codes is explained in the Enrolment-code and discount eligibility policy.
8. Certificates
Some courses issue a certificate. Unless a course page says otherwise, a Neda eCampus certificate is a certificate of completion: it records that the named person completed the course’s required activities on the stated date. It is not an accredited qualification, a professional licence, or a recognised academic award, and neither we nor creators claim it is equivalent to one. Where a creator is an accredited body and the course page says the certificate carries that accreditation, that statement is the creator’s.
A certificate is issued only on completion. If a purchase is refunded, any certificate issued for it is withdrawn, and we may say so to anyone who asks us to verify it. [CONFIRM — completion threshold and the refund-after-certificate rule are policy decisions still open, see build plan L-24.]
9. Your conduct
You may use course content for your own learning. You may not copy it, share your access, resell it, or use it to train an automated system, except where a licence on the course page allows it or the law permits it regardless. What you may and may not post on the platform — in forums, assignments and course content — is set out in the Acceptable Use Policy. If you believe content on Neda eCampus infringes your rights or is unlawful, the Copyright and takedown page explains how to tell us and what we will do.
10. Availability and changes
We aim to keep Neda eCampus available continuously, but it is not guaranteed: we carry out maintenance, and things outside our control fail. We will give notice of planned maintenance where we reasonably can. We may change features and add or retire courses; section 6 governs what happens to a course you have bought.
We may change these terms. If a change affects your rights in more than a trivial way, we will email you at least 30 days before it takes effect, and you may close your account before then if you do not accept it. Changes that are required by law or that only benefit you may take effect sooner. Continued use after the effective date is acceptance.
11. Suspension and termination
We may suspend or close your account if you seriously or repeatedly breach these terms or the Acceptable Use Policy, if we are required to by law, or if your account has been used to attack the platform or other users. Except where the law or the seriousness of the situation prevents it, we will tell you why, and you may reply to info@neda-els.com and ask us to reconsider. Closing your account does not by itself refund purchases; the Refund and Cancellation Policy applies.
12. Our liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for gross negligence or intent, or under consumer-protection statutes that apply to you. Subject to that, we are not liable for loss of profit, business or data, or for indirect loss, and our total liability to you in connection with a purchase is limited to the amount you paid for it.
Courses are educational. They are not professional advice for your specific situation, and you should not rely on them as such.
13. Law, courts and complaints
These terms are governed by Austrian law. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in the courts of that country. Information about out-of-court dispute resolution is on the Dispute resolution page. Questions and complaints about these terms: info@neda-els.com or the contact form.
These terms are available in English. Where we offer a machine translation, the English version governs.
